Abstract: The paper describes various kinds of ways of and the problems in tailings resources recycling and points out that the recycling of mine tailing resource must adopt a recycle economic mode both technically and from legal system, analyzes the status quo and problems of the legal system concerning the tailing resource recycling and discusses the ecology, compatibility and sustainability of the relevant legal system.On this basis, it is pointed out that for an efficient exploitation of tailing resource, in addition to technical innovation, it is of great importance to establish a legal system of tailing resource recycling based on the Law of Tailing Resource Recycling so as to promote the exploitation and utilization of tailing resource by means of administrative enforcement of law and juridical enforcement.
